CAL PROP 65 – Safe Drinking Water and Toxic Enforcement Act


Product Safety – this blog will focus on CAL PROP 65, also known as the Safe Drinking Water and Toxic Enforcement Act of 1986. This law, which applies to all products distributed in the sate of California, is intended to protect consumers from toxic substances that can cause cancer, birth defects, or other reproductive harm. It requires businesses to notify Californians about significant amounts of chemicals in the products they purchase and use. Over 800 chemicals are currently on this list, and the list is updated at least once a year. The law is administered by the Office of Environmental Health Hazard Assessment (OEHHA), and enforced by the California Attorney General’s Office.  Private enforcers (or bounty hunters) also have the right to bring lawsuits against alleged violators of Prop 65, and they are entitled to recover their attorney’s fees and a portion of the monetary settlements with the state.
